• Fences taller than 3′ need a building permit from Development Services; anything 3′ or under is exempt. The separate single-family fence permit is $180, or $120 when pulled with a single-family building permit.
• In SF-15, SF-10, SF-8, SF-7, SF-6, SF-D and SF-A, a front perimeter wall or fence abutting a street is limited to 3′, solid or open. In SF-43 and SF-35 it may be 8′ on an arterial street and 3′ on any other street, and a front fence that does not abut a street may be 8′ in every single-family district.
• Rear perimeter walls and fences in single-family districts may be 8′, whether the rear abuts a street, a public alley, another single-family lot, multi-family, or non-residential property.
• A swimming pool must be enclosed by the walls of the house or by a solid wall or a chain link or wrought iron fence not less than 5′ and not more than 6′ high, with openings too small to pass a 4-inch sphere. Gates must be substantially the same height and self-closing and self-latching.
• Chain link security fences are not permitted in single-family residential districts.
• There is no blanket neighbor-consent height threshold. Deviating from the wall and fence standards requires a Wall and Fence Modification processed as a Conditional Use Permit, and for a perimeter or separation wall or fence you must get notarized signatures from a majority of abutting property owners.

Do you need a permit? Yes, over 3'. The Technical Codes of the Town of Gilbert amend the work-exempt-from-permit lists of both the building code at Section 105.2 and the residential code at Section R105.2 to read fences not over three feet high, so a fence taller than 3' needs a building permit and one at or under 3' does not.
